On December 12, 2008 permission was granted for the LMA:
"archive.org:
This is Hank Osterhout from the band Deadman Flats.
I'm writing to give permission for archive.org to post/archive live recordings (both soundboard and audience) of our concerts for public download and noncommercial, royalty-free circulation.
Anyone may upload live recordings of Deadman Flats.
All shows hosted are to be made available in both lossless (flac/shn) and lossy formats (mp3/vbr).
In no case may any officially-released Deadman Flats recording (live or studio) be duplicated or otherwise traded or offered.
If Deadman Flats chooses to offer for sale (via physical media such as CD, or via digital download) a particular performance by Deadman Flats, this Official version will take precedence over all recordings being offered for download.
In these instances, we require that digital audio repositories remove any recording of these particular performances from their collections within 7 days of the official release or 7 days of Deadman Flats announcing the intention to release, whichever is earlier.
Deadman Flats will inform archive.org of the current list of Deadman Flats' officially released recordings and archive.org will maintain their site accordingly.
Notwithstanding the above, Deadman Flats reserves the right to require immediate removal of any unreleased Deadman Flats material.
We reserve the right to withdraw or alter our sanction of recording, tape trading, and/or non-commercial digital audio file transfers on a case specific basis or in general, as we deem necessary.
No waiver of any copyright or trademark right is intended.
